TERMS AND CONDITIONS OF PURCHASE AND USE OF PARKING SERVICES
SHORT TERM PARKING
1. INTRODUCTION AND INFORMATION ABOUT AIMO PARK NORWAY AS ETC.
These terms and conditions apply to purchase of all defined short term parking services and additional services (the Parking Services) through the website www.aimopark.no and other websites operated by Aimo Park Norway AS. The seller of the Parking Services is Aimo Park Norway AS (hereinafter Aimo Park), registration no. 946 359 106, business address: Ole Deviks vei 2, 0666 Oslo. Inquiries to Aimo Park, including any complaints, can be directed to imo Park Norway AS, P.O.Box 6514 Etterstad, 0606 Oslo, +47 21 00 76 70 or by e-mail to kunde@aimopark.no. When booking Parking Services from Aimo Park, the customer accepts that these terms and conditions apply to the agreement between the customer and Aimo Park.
2. BOOKING/AGREEMENT
Booking is conducted through the procedure stated on Aimo Park's website. A binding agreement regarding purchase of Parking Services is concluded when you have paid for the service in accordance with the procedure stated on the website and received your order confirmation.
3. WHAT THE PARKING SERVICES INCLUDE
The Parking Services comprise a right to use a parking space at a given time period as stated in your booking confirmation.
4. CANCELLATION
If you purchase the cancellation fee, you can cancel a pre-booking one hour prior to the booking time. A Pre-booking without the cancellation fee cannot be cancelled.
5. RIGHT OF CANCELLATION (NW: ANGRERETT)
The customer is entitled to cancel the booking in accordance with the Cancellation Right Act (Nw: Angrerettloven) of 20 June 2014 when Parking Services are booked through the Internet or by telephone.
The cancellation right is exercised by notifying Aimo Park in clear language that the right is exercised. Such notification can be made by submitting the enclosed cancellation form or by contacting Aimo Park by mail or e-mail to the addresses specified in paragraph 1 above. The deadline for exercising the cancellation right is 14 days after the agreement is concluded.
When the cancellation right is exercised, the parties' obligations under the agreement will lapse. Any pre-payment will be refunded to the customer and registration of vehicles for access to parking sites will be cancelled.
If you book a Parking Service with startup-time that is less than 14 days from the booking is made, you will be deemed to have requested the commencement of delivery of the service before the expiration of the cancellation period. Upon such a request for the commencement of delivery, you agree that Aimo Park will start to deliver the Parking Service before the cancellation period has expired. If you use your cancellation right before the cancellation period expires , but after the delivery of the Parking Service has commenced, Aimo Park is entitled to require payment of an amount proportionate to what is delivered up to the time you give notice of exercise of the cancellation right.
If delivery of the Parking Service has commenced pursuant to request, cf above, and the service is completely delivered before expiry of the cancellation period, i.e. that the time period for which the Parking Service is booked has expired before the cancellation right is exercised, the customer's cancellation right will lapse, cf the Cancellation Right Act section 22 c).
The customer's rights under the Purchase of Goods Act or the Consumer Purchase of Goods Act apply irrespective of and in addition to the cancellation right.
6. PRICE/RENT
Prices/rent to be paid for the Parking Services will vary between the different services and duration. The prices are dynamic and may be changed from time to time without prior warning pursuant to changes in capacity/offer/demand. Your price will be calculated based on the relevant service and booking time.
All prices shown are in NOK and include VAT in accordance with current rates.
7. PAYMENT
All Parking Services are pre-paid when booked. All payments must be done by credit card.
8. ACCESS TO PARKING SITES - CUSTOMER IDENTIFICATION
8.1. Use of parking sites with pre-booked spaces
8.1.1. Parking before and after pre-booked parking time – sites with Barriers
If you enter or depart the site at another time than the pre-booked time (if you e.g. arrive earlier than as stated in the booking, or depart later than the booked time), you must pay ordinary short time parking tariff for the parking site. Payment will be required before leaving the parking site.
8.1.2. Parking before and after pre-booked parking time – sites without Barriers
If you enter or depart the site at another time than the pre-booked time (if you e.g. arrive earlier than as stated in the booking, or depart later than the booked time), you must pay ordinary parking fare by payment on parking meter or by using EasyPark (mobile phone payment). If you park at a time other than the pre-booked time without paying ordinary parking fare, you risk receiving a control sanction.
8.2. Procedure for entering and departure
8.2.1. Entering and departure – sites with barriers and QR code
When arriving at the gate of the parking site where you have booked your parking space, it is important that you follow the instructions you received in your booking confirmation. Upon entering the site, the QR code received in your booking confirmation must be scanned on the pillar. You will then receive a ticket from the pillar. This ticket is used when departing the site. Please make sure that you are prepared and that you bring your code with you on print/paper. If you do not bring your correct code, you risk not getting access to the parking site.
8.2.2. Entering and departure – sites with barriers, cameras and recognition of license plate
When arriving at the gate of the parking site where you have booked your parking space, it is important that you follow the instructions you received in your booking confirmation.
In parking sites with cameras, the license plate number on your vehicle that you have submitted when you booked the Parking Service will be recognized and you will receive a parking ticket from the pillar. This ticket is used when departing the site.
Please make sure you have submitted the correct registration number on your booking. If an incorrect registration number has been submitted, you will not get access to the site.
8.2.3. Entering and departure – Parking sites without barriers/open sites (license plate number as parking ticket)
When arriving at the gate of the parking site where you have booked your parking space, it is important that you follow the instructions you received in your booking confirmation. In parking sites without gates, your license plate number will be your "digital parking ticket".
Please make sure you have submitted the correct license plate number on your booking. If an incorrect license plate number has been submitted, you risk receiving a control sanction.
9. USE OF PARKING SITES
The customer shall park on the space(s) indicated in the agreement and within the indicated parking bays. Car wash, service, repair, etc. is not permitted on the parking site or in areas adjacent to the parking site. The customer is obliged to comply with the rules and regulations for the relevant site as determined by Aimo Park from time to time. The customer accepts that the parking space can, for shorter period, be unavailable due to maintenance and/or repairs. Aimo Park will use its best endeavors to notify the customer of such events through signs/posters as far in advance as possible.
The parking site shall be used only for parking of vehicles. The parking site shall not be used for storage or abandoning of objects or vehicles without valid registration number. Aimo Park reserves the right to remove such objects or vehicles for the customer's expense.
Subletting of parking spaces is not allowed.
Aimo Park accepts no responsibility for the customer's use of the parking site, including any delays that may be caused by defects in gates etc. The customer is responsible for any damage or inconvenience imposed on persons, building with technical installations, cars or other goods inflicted by the customer or persons that he has admitted to the parking site during such persons' traffic in the parking site. Aimo Park is not responsible for theft or damage incurred on the customer's vehicle for any reason. The Parking Services must not be used otherwise than as stipulated in the agreement without the written consent of Aimo Park.
10. TERMINATION OF THE AGREEMENT
The end date for the Parking Service is specified in your booking confirmation. Aimo Park reserves the right to terminate the agreement before the end date in the event that Aimo Park's lease for the relevant parking site, for any reason, ceases. The customer accepts eviction without a court order upon termination of the agreement or if the rent is not paid, cf. the Enforcement Act § 13-2 third paragraph letter a) and b). Claims against Aimo Park cannot be offset in Aimo Park's claim towards the customer unless such claim has been recognized by Aimo Park or legally settled.
11. APPLICABLE REGULATIONS FOR AIMO PARK'S BUSINESS
Aimo Park's operations are subject to the provisions of the Regulation on conditions for parking for the general public and the enforcement of private parking of 18 March 2016. In the event of changes in the Regulation, Aimo Park reserves the right to amend these terms and conditions to comply with the Regulation.
12. PRIVACY POLICY
12.1. Privacy Policy
Any personal data you provide when you use the website or book services from Aimo Park will be handled in accordance with our Privacy Policy. Aimo Park complies with applicable Norwegian personal data legislation. All personal data collected through our website is handled in accordance with the relevant regulations. Aimo Park is the data controller. The customer's rights are set forth in the Personal Data Act. It is voluntary to submit personal data to Aimo Park. The customer is free to request information about the processing of personal data that takes place in conjunction with Aimo Park's services. The customer also has the right to demand correction of inaccurate information. Inquiries regarding the privacy policy should be addressed to Aimo Park to the addresses and telephone numbers provided in paragraph 1 above.
12.2. Collection of personal data
The purpose of collecting personal data is to enable Aimo Park to provide services to customers. Aimo Park collects personal data from customers in connection with booking of Parking Services or if customers require information about other Aimo Park services. Personal data that is collected include e-mail, name, address, telephone number and credit card number.
12.3. Collection of other information
Aimo Park also collects certain information about your hardware and software (cookies). This information can include: your IP address, browser type, operating system, domain names, access times and referring site addresses. This information is used to operate the services, to maintain quality of services and to provide general statistics regarding use of the web pages. Such information is not linked to your personal data.
12.4. Use of personal data
Aimo Park uses personal data to provide products and services and other information that you request, or which are necessary in connection with the purchase of products or services. It is also used to inform you about special offers, updated information and other new services from Aimo Park, but only if you have agreed to it in advance. Same as stated above, Aimo Park only forwards personal data to others when this is in compliance with the relevant prevailing personal data legislation. Personal data is kept secure and confidential and is stored only as long as necessary to fulfill the purpose that the data was collected for.
13. GENERAL
Agreements with Aimo Park concluded through the Internet or telephone are subject to the applicable sale- and purchase legislation. Aimo Park reserves the right to change these terms and conditions if deemed necessary. Your booking will be subject to the prevailing terms and conditions as per the time of your booking. Aimo Park is a member of the Parking Appeals Board.
LONG TERM PARKING

2. BOOKING/AGREEMENT
Booking is conducted through the procedure stated on Aimo Park's website, through e-mail inquiry or via Aimo Park's phone-based booking system.
A binding agreement regarding purchase of Parking Services is concluded when you have paid for the service in accordance with the procedure stated on the website and received your order confirmation.
3. WHAT THE PARKING SERVICES INCLUDE
The Parking Services comprise a number of parking spaces in the category(s) and the space(s) as defined in your booking confirmation. If you book/rent a free-float space, you are not entitled to a defined reserved parking space, but you are only entitled to use an available parking space. Aimo Park cannot guarantee that there will be available spaces at any time. If no space is available, the customer will, if possible, be re-directed to an alternative parking space by contacting Aimo Park. Aimo Park cannot guarantee that unauthorized persons do not access and occupy a reserved space.
4. RIGHT OF CANCELLATION (NW: ANGRERETT)

5. PRICE/RENT
Prices/rent to be paid for the Parking Services is stated on Aimo Park's website. Your applicable price/rent will appear in the received booking confirmation. In addition to rent, the customer will be charged with a deposit or a one-time fee for parking permit/access card/gate opener/key and an invoicing fee for each invoice. For e-invoice there are no invoice fee. Aimo Park is entitled to adjust the price/rent according to the consumer price index or according to market rates for comparable leases. Such adjustments will take place pursuant to written notice, with a notice period corresponding to the relevant notice period for termination of the relevant Parking Service. Any changes in public duties or the introduction of new government taxes will be charged to the customer from the time such changes take effect. All prices shown are in NOK and include VAT in accordance with current rates.
6. PAYMENT
Payment is to be made according to distributed invoice. The relevant payment interval (monthly, quarterly, semiannually or annually) will be stated in your booking confirmation. Invoices are sent by e-mail.
7. ACCESS TO PARKING SITES - CUSTOMER IDENTIFICATION
7.1. Parking sites with registration of vehicle registration numbers
The customer must register the registration number(s) of the vehicle(s) that will use the Parking Service(s). Such registration and any subsequent re-registration, see below, must be executed by the customer himself at Aimo Park's website or through the customer's mobile phone. The registration gives you the right to use the relevant Parking Services for the vehicle(s) that is registered with Aimo Park. The customer can register an unlimited number of vehicles that can use the Parking Services, but the customer can only have registered a number of active vehicles that corresponds to the number of parking spaces that the relevant purchased Parking Services comprise. The customer must himself ensure that the correct vehicle(s) is registered as active at any time through the website or mobile phone. If the agreement comprises one parking space, the customer can hence only have registered one active vehicle at the time. It is possible to change the registration of the vehicle(s) that can use the Parking Service(s). This is done by changing the vehicle registration numbers on the website of Aimo Park or via the customer's mobile. Only the vehicle(s) that is registered with Aimo Park at any time can use the Parking Services. If the registration of the vehicle(s) are incorrect the customer may be issued a control fee.
7.2. Parking sites with access cards and/or parking permit etc.
Upon entering into the agreement, a number of parking permits /access cards/ gate openers/keys corresponding to the number of parking spaces that the agreement comprises will be issued to the customer. It is the customer's duty to ensure that the parking permit is always clearly visible and fully readable from outside the car behind the car's windscreen when the parking site is used. One cannot park without a valid parking permit. A copy of the parking permit is not considered valid parking permit. If the customer has not received a parking permit from Aimo Park before commencement of the agreement, the customer must contact Aimo Park to receive this. If the customer does not bring the parking permit when using the parking site, the customer must pay regular fare for parking. If the parking fare is not paid, the customer may be imposed a control fee from Aimo Park's inspectors. This regulation is strictly enforced in order to ensure that there are available parking spaces at all times for those who is legitimately renting parking spaces from Aimo Park. Imposed control fees cannot be expected to be withdrawn.
Your parking permit/access card/gate opener/key is your customer identification. Aimo Park's
personnel is not able to grant exemptions from the use of a parking permit/access card/gate opener/key.
Loss of parking permit/access card/gate opener/key must be reported to Aimo Park in writing as soon as possible. A new parking permit/access card/gate opener/key will not be distributed before such written notice is received by Aimo Park. Deposit or a one-time fee must be paid for key/access card/gate opener. In the event of loss of units for which a deposit paid, the paid deposit or one-time fee will not be returned from Aimo Park, and additional deposit or one-time fee for a new unit must be paid.
For replacement of a lost parking permit a fee of NOK 200,00 is charged. The parking permit/key/access card is valid only on the parking site(s) to which your relevant agreement applies, and until expiry or revocation of the agreement upon default by the customer.
7.3. Parking sites with divergent regulations – additional information
Some parking sites may have arrangements/regulations which differ from those described in paragraphs 7.1 and 7.2 above. Some sites are, for instance, closed at night, there may be maximum height limits for entering vehicles etc. Such specifications, regulations and information for the relevant site will be stated on the website. The customer is responsible for obtaining knowledge of such information.

Car wash, service, repair, etc. is not permitted on the parking site or in areas adjacent to the parking site. The customer is obliged to comply with the rules and regulations for the relevant site as determined by Aimo Park from time to time. The customer accepts that the parking space can, for shorter period, be unavailable due to maintenance and/or repairs. Aimo Park will use its best endeavors to notify the customer of such events through signs/posters as far in advance as possible.

9. AMENDMENTS TO THE AGREEMENT
Amendments to the agreement, for example reduction in the number of parking spaces or booking of another Parking Service, is done by contacting Aimo Park. Amendments that constitute a reduced Parking Service will take effect after the expiry of the notice period for the relevant Parking Service.
10. TERMINATION OF THE AGREEMENT
The agreement commences on the date specified in your booking confirmation.
If an end date for the Parking Service is specified on the website or in your booking confirmation, the agreement will expire automatically at the specified time. If no end date is specified, the agreement will be valid until the customer or Aimo Park terminates the agreement, see below.
The agreement may be terminated by both the customer and Aimo Park with such notice period as agreed for the relevant Parking Service. The notice period may be 1 month, 3 months, 6 months or 12 months. Your notice period will be stated on your booking confirmation. The notice period runs from the 1st of the month after the notice is sent. If for example, the notice period is one month and a termination notice is sent on 15 March, the notice period commences on 1 April and the agreement will expire on 30 April. If the notice period is 3 months, the agreement will expire on 30 June.
Notice of termination shall be given in writing. The termination notice must be sent by mail or email to Aimo Park to the addresses specified in paragraph 1 above. Aimo Park reserves the right to terminate the agreement on a shorter notice in the event that Aimo Park's lease for the relevant parking site, for any reason, ceases.
If the customer has received a parking permit/access card/gate opener/key, this shall be returned immediately after termination of the agreement. In the event of continued use of the parking space after termination, Aimo Park will invoice full rent until such use ceases, or impose control charges or remove the vehicle for the customer's expense and risk. Paid deposits for parking permit/access card/gate opener/key will be repaid to the customer when the relevant device is returned to Aimo Park (does not apply to one-time fees). Please state your account number when you return the access card/gate opener/key.
Aimo Park is entitled to terminate the agreement with immediate effect if the customer is in material breach of the agreement. Non-payment is considered a material breach. Aimo Park may claim settlement of outstanding rent upon return of vehicles that has been removed/towed.
The customer accepts eviction without a court order upon termination of the agreement or if the rent is not paid, cf. the Enforcement Act § 13-2 third paragraph letter a) and b). Claims against Aimo Park cannot be offset in Aimo Park's claim towards the customer unless such claim has been recognized by Aimo Park or legally settled.
